13-Year-Old Companion Still in Hospital; Authorities Try to Determine Who Drove
Richard H. Smaxwell, 15, 2101 E. Wisconsin avenue, found about 11 p.m. Sunday trapped in a stolen station wagon wrecked against a tree at 2281 E. Wisconsin road, died at 4 p.m. Monday in Appleton Memorial hospital.
Two other highway accidnet deaths raised the state's 1959 toll to 623, compared with 615 on this date a year ago.
    Stolen From Lot
Smaxwell died of multiple severe head injuries without regaining consciousness. Three men pried open a door of the station wagon to remove Smaxwell, trapped under the dashboard. A 13-year-old companion was found walking around the wreck in a state of shock. He had a broken jaw and facial cuts. His condition has prevented further questioning by authorities.
The 1958 station wagon was stolen from the Mullen Electric company parking lot, 2002 E. Wisconsin, just a few blocks from where the vehicle left Highway 96, traveled 30 feet and slammed into a tree, County Patrolman Joseph VandenOever said. The car was owned by Midwest Car corporation, 220 Lawe street, Kaukauna, and leased to the Mullen firm.
Coroner Bernard H. Kemps this morning said an inquest probably will be held. It has not been definitely established who drove the car, althouth the 13-year-old boy indicated to Vanden Oever that he was driving when questioned after the accident. However, Vanden Oever noted the youth was in a state of shock and was not fully coherent. The boy remains in Appleton Memorial hospital.
Kemps said it must be established who drove the car and plans a confeerence with juvenile authorities and the ditrict attorney.
    20th Road Death
Smaxwell's death is the 20th this year in Outagamie county -- twice last year's total at this time and two more than the entire 1958 toll.
Smaxwell was the son of Mr. and Mrs. Herman Smxwell.
